1. Introduction

These Terms & Conditions (“T&C”) explain how you (“User” or “Customer”) can use our websites and online services like booking a vehicle, test rides, e-KYC, insurance, and financing.
Our websites include youdhaauto.com, lohiaauto.com, and related platforms.
By using these websites or services, you agree to follow these rules and our Privacy Policy.

2. Eligibility & Age Consent

  • You must be 18 years or older to use our services.

  • If you want a test ride, you need a valid driving license.

You must follow all legal rules to use services like booking, insurance, financing, and payments.

3. User Responsibilities & Data Accuracy

  • You are responsible for ensuring that all personal information and documents submitted during registration, booking, or e‑KYC are accurate and legitimate.

  • Lohia Auto/Zuperia Auto (hereinafter “Company”) is not obligated to independently verify such data but reserves the right to refuse or terminate any transaction or service if any misrepresentation or misuse is detected.

  • You agree to indemnify the Company and its partners against any losses, liabilities, or costs arising from false information or fraudulent documentation.

4. Fair Usage & System Integrity

  • Users must not deploy bots, malware, or scripts to exploit or disrupt the website and must maintain updated, secure computer systems.

  • The Company reserve the right to suspend or block usage if misuse is detected.

5. Privacy & Processing of Personal Data

  • We follow Indian privacy laws and our Privacy Policy when handling your personal data.

  • If you don’t agree with how we use your data, please don’t use the website.

6. Transaction Framework & Third‑Party Services

  • The platform facilitates transactions between you and authorized dealerships, with payments processed securely via third-party payment gateways. The Company does not store confidential payment details.

  • Services such as insurance, vehicle financing, or post‑sale services are provided by third parties; dealerships coordinate delivery and documentation.

  • You remain free to opt out of third-party offerings or select alternate service providers as permitted.

7. Product Information & Pricing

  • We try to show correct details about vehicles, prices, and features, but errors may happen.

  • Final price and features will be confirmed at the dealership.

  • Site information is for personal use only, not for business.

8. Online Booking Process

  • Online bookings require OTP‑verified mobile number and email. Identity and address proofs (as per RTO norms) must be provided. Failure to furnish valid documents may result in cancellation and full refund of booking amount.

  • A booking becomes effective only when the online payment is successfully received. Where payment is deducted by your bank but not captured by the payment gateway, the booking remains pending and may be cancelled; refunds are processed within seven working days.

9. Modifications & Booking Changes

  • You can change your booked vehicle to another model (if available in the same dealership) before making the full payment. Any price difference must be paid online; confirmation of change will be communicated via email.

10. Cancellations & Refunds

  • You can cancel the booking before final payment. Contact the dealership directly for assistance.

  • Refunds are processed by the dealership to the original payment account. Once final payment is made, cancellations are not allowed.

11. Test Rides, e‑KYC & Document Inspections

  • Test ride scheduling is subject to dealership confirmation. Dealerships may deny or cancel scheduled rides at their discretion without obligation.

  • Original document verification and receipt of delivery occurs at the dealership. Dates provided are subject to change.

12. Pricing, Final Invoice & Delivery

  • Listed prices on the website are subject to change. Final on-road price including taxes, insurance, RTO fees, subsidies, optional charges is calculated at the time of invoice.

  • Difference between booking price and final price must be settled by the customer or reimbursed by the dealership.

  • Delivery schedules are indicative; dealerships may reschedule at their discretion. Customer must collect the vehicle in person from the selected dealership.

13. Vehicle Registration & After‑Sales Services

  • Registration is done through the local RTO associated with the selected dealership. You are responsible for providing valid local address proof. Incomplete or invalid documentation may lead to order cancellation.

  • After‑sales service is available at authorized dealerships; you are responsible for bringing your vehicle there at your own expense.

14. Offline (“Manual”) Booking Process

  • If you choose offline booking at a dealership, everything is handled manually; the online portal serves only as a reference and does not reflect offline bookings

15. Intellectual Property Rights

  • All content (images, logos, text, trademarks) on the website is the property of the Company. Personal, non-commercial use is permitted; copying, redistribution, or commercial use without written consent is prohibited and may result in legal action.

16. Limitation of Liability

  • Your use of the site, products, services, and third-party offerings at your own risk.

  • The Company disclaims all warranties (express or implied). Liability is limited to the booking amount for a vehicle or actual damages if any.

  • The Company has no liability for any third-party products or services.

17. Indemnity

  • You agree to indemnify and hold harmless the Company, its directors, officers, employees, affiliates, partners, vendors, agents, and representatives from any claims, losses, liabilities, costs, or expenses arising from your use of the website, breach of T&C, infringement, or false information provided.

18. Force Majeure

  • Neither party is liable for failure or delay in performance due to causes beyond control, including (but not limited to) government restrictions, natural disasters, epidemics, strikes, or other extraordinary events.

19. Governing Law & Dispute Resolution

  • These T&C are governed by Indian law.

  • Any disputes or claims arising shall be adjudicated exclusively in courts located in New Delhi, INDIA.

20. Authorization for Use of Logos and Words (Mobile App Publishing & Marketing)

  • The Company hereby authorizes Racketail Solutions and Technologies Pvt. Ltd. to use certain brand assets for the purpose of developing, publishing, and promoting the Company’s mobile applications in the Google Play Store and related environments.

  • The authorized assets include:

    • Logos: Official brand logos of the Company (as designated by the Company).

    • Words/Brand Names: “My Youdha”, “Youdha Connect”, and “Youdha”.

  • This authorization permits Racketail Solutions and Technologies Pvt. Ltd. to use the above-mentioned logos and brand names strictly for activities related to mobile app publishing, marketing, and promotion of the Company’s applications.

  • The Company retains all rights, titles, and interests in its intellectual property. This authorization does not transfer ownership of any logos, trademarks, or brand names but grants limited usage rights solely for the purposes stated above.

  • Any misuse, unauthorized reproduction, or use of these assets outside the approved scope will result in immediate revocation of this authorization and may lead to legal action.
